These Terms and Conditions ("Agreement") govern your use of Krienta's website and your engagement of Krienta's interior design and soft furnishings consultancy services. By submitting an enquiry, entering into a service engagement, or using this website, you agree to be bound by these terms. If you do not agree, please do not proceed. 1. Definitions
- "Krienta", "we", "us", "our" — the interior design consultancy operating under the Krienta name, based at Jalan Telawi 5, Bangsar Baru, 59100 Kuala Lumpur, Malaysia.
- "Client", "you", "your" — any individual or entity who engages Krienta's services or uses this website.
- "Services" — window dressing consultations, soft furnishings packages, whole-home soft layer documentation, and any associated services provided by Krienta.
- "Engagement" — a confirmed service booking between Krienta and a Client.
- "Documentation" — written direction documents, fabric schedules, hardware schedules, sequencing notes, and other deliverables produced by Krienta.
- "Makers" — third-party curtain makers, upholsterers, and fabric suppliers engaged in the production of items specified by Krienta.
- "Website" — the Krienta website at https://krienta.info.
2. Acceptance
By using this Website or engaging our Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Use of the Website or submission of an enquiry form constitutes acceptance of these terms. If acting on behalf of a company, you confirm that you have authority to bind that company.
3. Services
Krienta provides the following consultancy services:
- Window Dressing Consultation (from RM 380)
- Soft Furnishings Package (from RM 1,650)
- Whole-Home Soft Layer Documentation (from RM 2,950)
Services are primarily available within the Kuala Lumpur and Petaling Jaya areas. Travel to locations further afield may be subject to a travel supplement to be confirmed in writing before engagement. Service availability is subject to Krienta's capacity and scheduling. The precise scope of each engagement is confirmed in writing before commencement.
4. Engagement and Scope
An engagement is confirmed when Krienta issues a written confirmation and the Client acknowledges it, or when a deposit is received where applicable. The scope of each engagement is defined in writing at the outset. Any changes to the agreed scope require written agreement from both parties. Krienta may decline to proceed with changes that materially alter the engagement without a revised agreement.
Krienta's services cover the design and coordination layer only. Fabric, hardware, and making costs are separate and are paid by the Client directly to the relevant suppliers and makers. Krienta does not mark up or receive commission on these costs.
5. Client Responsibilities
- Provide accurate information about the home, including dimensions, existing finishes, and any constraints, to enable Krienta to advise appropriately.
- Provide access to the property at agreed times for on-site visits and installation placement.
- Review and approve direction documents and shortlists within the timeframes requested by Krienta.
- Engage and pay makers directly in accordance with Krienta's recommendations and specifications.
- Notify Krienta of any changes to the property or project scope that may affect the engagement.
6. Intellectual Property
Direction documents, fabric schedules, hardware schedules, and all other written deliverables produced by Krienta remain the intellectual property of Krienta until fees are paid in full. Upon full payment, a non-exclusive licence to use the documentation for the purpose of the relevant project is granted to the Client.
The Client may not reproduce, redistribute, or commercialise Krienta's documentation without written consent. All website content, including text and design, is owned by Krienta and may not be reproduced without permission.
7. Fees and Payment
Fees for each engagement are confirmed in writing at the outset. All prices are in Malaysian Ringgit (RM) and inclusive of applicable taxes unless stated otherwise. Payment is due as specified in the engagement confirmation. Krienta reserves the right to suspend work if payment is not received when due.
Where a deposit is required, it is non-refundable once Krienta has commenced work on the engagement, including scheduling and preparation for on-site visits. Cancellations made before any work has commenced may be entitled to a full refund of any deposit paid, at Krienta's discretion.
Krienta does not accept responsibility for costs incurred directly with makers or suppliers.
8. Timelines
Krienta will provide indicative timelines for each engagement. These are estimates and are subject to Client approval timescales, maker availability, and factors outside Krienta's control. Krienta will communicate any delays that arise. Krienta is not liable for delays caused by third-party makers or suppliers.
9. Makers and Third Parties
Krienta coordinates with makers as part of certain service engagements. The Client's contractual relationship for production work is directly with the maker, not with Krienta. Krienta exercises reasonable care in recommending makers but does not warrant the workmanship of third parties. Any disputes regarding production quality are between the Client and the maker concerned.
10. Disclaimers
Krienta's services are provided as professional interior design consultancy. We do not provide structural, engineering, or building advice. Recommendations are made in good faith based on observed conditions at the property.
Fabric and material behaviour may vary due to environmental conditions beyond our assessment at the time of the engagement. Krienta cannot warrant the performance of any material over time in conditions not observed during the engagement.
11. Limitation of Liability
To the extent permitted by Malaysian law, Krienta's liability to the Client in respect of any engagement is limited to the fees paid by the Client for that engagement. Krienta is not liable for indirect, consequential, or incidental losses, including loss of income, damage to property, or costs incurred with third-party makers.
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
12. Indemnification
The Client agrees to indemnify and hold Krienta harmless against any claims, losses, or expenses arising from the Client's breach of these terms, inaccurate information provided to Krienta, or any dispute between the Client and a third-party maker or supplier.
13. Termination
Either party may terminate an engagement with written notice. If Krienta terminates due to the Client's breach or failure to cooperate, fees for work completed to that point remain due.
If the Client terminates, any deposit paid is non-refundable once work has commenced. Fees for work completed prior to termination are payable at a pro-rated rate based on the scope completed.
14. Dispute Resolution
In the event of a dispute, the parties agree to attempt to resolve the matter informally by written communication within 30 days before pursuing formal proceedings.
These terms are governed by the laws of Malaysia. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Malaysia, and specifically those located in Kuala Lumpur.
15. General
- Entire agreement: These terms, together with any written engagement confirmation, constitute the entire agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that right.
- Assignment: Krienta may assign these terms without notice. The Client may not assign without Krienta's written consent.
- Notices: Notices may be given by email to the address on record for each party.
16. Changes to These Terms
We may update these terms from time to time. The current version is always available on this page. Continued use of the Website or engagement of Services after any update constitutes acceptance.
